Appointment of Professors according to Section 99a of the Universities Act
Consultation of the university professors of the subject area to which the position according to section 99a of the Universities Act is assigned – selection of the group of parties entitled to be heard
§ 1. (1) If the Rector intends to make an appointment pursuant to section 99a of the Universities Act, the Rector informs the head of the responsible academic organisational unit and the representatives of the university professors including the heads of organisational units with research and teaching tasks who are not university professors elected to the Senate about the following in writing:
1. the prospective candidate for the professorship pursuant to section 99a of the Universities Act;
2. the intended subject dedication for this professorship; and
3. the intended selection (to be specified by names) of the group of university professors of the subject area to which the position is assigned.
(2) The head of the responsible academic organisational unit and the representatives of the university professors including the heads of organisational units with research and teaching tasks who are not university professors elected to the Senate may, within a period of one week, unless the Rector specifies a longer period, individually raise written objections with the Rector against the intended group of university professors entitled to be heard.
(3) After expiry of this period and after consultation with the head of the responsible academic organisational unit, the Rector selects, after considering any objections pursuant to para. 2, the group of university professors in the subject area to which the position is assigned.
Implementation of the hearing
§ 2. (1) The Rector informs the group of university professors of the subject area to which the position is assigned, as selected in accordance with section 1, para. 3, about the following:
1. the prospective candidate for the professorship pursuant to section 99a of the Universities Act;
2. the intended subject dedication for this professorship;
3. the reasons why the prerequisites pursuant to section 99a of the Universities Act are fulfilled; and
4. the date of a public presentation at the faculty which is held by the prospective candidate
and, if possible, submits two expert reports on the prospective candidate.
(2) Within the framework of the invitation to the public presentation at the faculty, the members of the faculty conference will be provided with a short academic profile (academic curriculum vitae) of the prospective candidate.
(3) Any person from the group of university professors of the subject area to which the position is assigned, as selected in accordance with section 1, para. 3, may individually submit to the Rector a written statement on the intended appointment within a period of two weeks, unless the Rector specifies a longer period.
(4) In cases of particular urgency, the Rector may begin hearing the university professors of the subject area to which the position is assigned at a time when the time limit for raising objections to the group of persons entitled to be heard (section 1, para. 2) has not yet expired. If, however, these objections result in the addition of further university professors to the group of persons, then the university professors who have subsequently been added to the group of persons are also granted a period of at least two weeks for their statements.
Implementation of the qualification assessment prior to an unlimited extension of the appointment
§ 3. (1) A temporarily appointed university professor according to section 99a of the Universities Act can apply for an unlimited extension after the fourth year as university professor (section 99a, para. 3 of the Universities Act), but no later than eleven months before expiration of the temporary employment.
(2) The Rector may lay down requirements for the format of the report on the achievements of the university professor.
(3) The Rector seeks at least three international expert reports on the report on academic achievements. The university professor, the head of the academic organisational unit and the Unit for Quality Assurance each propose to the Rector three impartial international reviewers with subject-related qualifications. Reviewers may not be contacted in advance. As a rule, the Rector selects one reviewer from each proposal.
(4) In any case, the member of the management team of the faculty or centre responsible for the area of teaching submits, on the basis of the available teaching evaluations, a statement on the teaching performance of the university professor since the commencement of the professorship according to section 99a of the Universities Act.
(5) If, on the basis of the results of the procedure, the Rector comes to the conclusion that an unlimited extension should be made, he/she hears the group of university professors entitled to be heard, as selected according to section 1 mutatis mutandis.
Entry into force
§ 4. (1) This part of the Statutes enters into force on 27 April 2018.
(2) Section 3, para. 1 and para. 4 as amended in the University Gazette on 1 July 2021, 43rd edition, number 198 enters into force on 1 October 2021.
