Terms and conditions for participation in the University of Vienna’s online prize draws

The promoter of the prize draw is the University of Vienna, Universitätsring 1, 1010 Vienna. 

By participating in prize draws of the University of Vienna, Universitätsring 1, 1010 Vienna, on social networks, such as META platforms (Facebook, Instagram or WhatsApp), Twitter, LinkedIn and Xing as well as on websites operated by the University of Vienna, such as medienportal.univie.ac.at, blog.univie.ac.at or other online applications attributable to the University of Vienna (e.g. Moodle), participants agree to the terms and conditions specified below and confirm that they have read and understood these terms and conditions.

 Terms and conditions

The prize draw is open to all natural persons whose principle place of residence is in Austria. Persons who have not yet reached the age of 18 (minors) need the consent of their legal representatives to participate in the prize draw.

Prize draws of the University of Vienna for university employees only are open exclusively to employees of the University of Vienna.

Furthermore, the University of Vienna reserves the right to exclude from the prize draw participants who violate the terms and conditions or who attempt to influence their chances of winning the prize draw through technical manipulations or through automated entries. Moreover, the University of Vienna reserves the right to request from participants evidence that they fulfil the terms and conditions of participation. If the participant fails to provide relevant evidence, the University of Vienna may exclude them from the prize draw. In case a participant is excluded from the prize draw, the University of Vienna may deny and reclaim prizes also in retrospect.

To participate in prize draws carried out via social networks that are not operated by the University of Vienna, participants have to register personally on the relevant platform using an active account. Only participants using their true name as their account name are eligible to participate. Participants using another person’s name or the identity of a third party are not eligible to participate.       
Participation in prize draws carried out via websites of the University of Vienna is not tied to an account on a social network. Therefore, any persons fulfilling the rest of the terms and conditions are eligible to participate.

By participating in the prize draw, participants do neither commit to purchasing a product nor do they incur any costs beyond the costs arising from the use of their data connection.

Participation in the prize draw is free of charge and independent of the purchase of goods and services. The chances of winning are not influenced by any achievements of the participants.

 Data protection

The University of Vienna stores the data of participants (except for the data of employees of the University of Vienna – they are subject to the Data Protection Declaration of the University of Vienna and the data protection declaration of the University of Vienna for the use of web-based services via SAML/Shibboleth including eduID and eduGAIN - (PDF, text in German language) only temporarily to the extent necessary to process the prize draw. The University of Vienna does not archive the data of prize draw participants. The University of Vienna deletes the personal data of prize draw participants after the prize draw has ended and the prizes have been awarded, unless there is a legal obligation to store the data temporarily.  Prize draw – participation and procedure

By participating in the prize draw, participants confirm that their contribution to the prize draw (in particular, images, photographs, texts, drawings) does not infringe the rights of third parties, especially copyright, producer rights, rights of exploitation and personality rights. If persons other than the participant have contributed to the preparation and development of the contribution to the prize draw, the participant has to obtain the permission of these persons for the submission and possible subsequent publication as part of the prize draw prior to submission of the contribution.

This also applies if third parties have been granted a right to the contributions submitted. If the photographs or drawings submitted show identifiable persons, the participants must obtain the consent of these persons to the submission and to the subsequent publication prior to submission within the framework of personality rights.

Participants are liable for ensuring that images, texts or other content uploaded by them do not violate any applicable laws or the rights of third parties.

By participating in the prize draw, participants grant the University of Vienna a free and limited right to use the contents they make available. By participating in the prize draw, participants entitle the University of Vienna to use, disseminate and publish the contents and/or images provided by the participants as part of the prize draw. Any further use of the contents and/or images made available by the participant by the University of Vienna, especially for advertising purposes, requires the express written consent of the participant.

The University of Vienna draws the winners and contacts them afterwards depending on the mode of the prize draw (e.g. by e-mail, telephone, etc.). Winners expressly consent in writing to the publication of their name; the winner’s name may not be published without their prior consent.

The University of Vienna reserves the right to modify or discontinue the prize draw without prior notice. This applies, in particular, in the event of force majeure or if the prize draw cannot be carried out or continued for organisational, technical or legal reasons.

Entries for the respective prize draw must be submitted by the closing date specified in the prize draw description. Further terms and conditions (such as type and duration of the prize draw, type and value of the prize) are specified in the relevant prize draw description. There is no right of appeal; in particular, there is no legal right to participate in the prize draw. The promoter does not offer cash or other alternatives to the prize, such as exchanging the prize or transferring it to other persons.

Winners will usually be notified within ten working days of the prize draw’s closing date at the latest. If the contact details provided by the winners are incorrect (e.g. e-mail address), the promoter is not obliged to search for their correct addresses. Any disadvantages arising from the provision of incorrect contact details (e.g. incorrect e-mail address) are at the expense of the relevant participant.

Winners must confirm that they accept and claim the prize within ten working days of receiving the notification from the University of Vienna at the latest. Afterwards, winners have four weeks to collect their prize. Prizes must be collected at the Main Building of the University of Vienna. If this is not the case, the promoter will notify the winners where they can collect their prize.

If a winner does not confirm that they accept and/or claim the prize within 10 working days for whatever reasons or if they do not collect their prize within four weeks for whatever reasons, their prize entitlement will be void. The University of Vienna reserves the right to redraw a new winner after the relevant deadline has expired.

 Liability

The University of Vienna is liable only for damages caused by intentional or grossly negligent behaviour. The University of Vienna does, in particular, not assume liability for the prize draw actually being accessible and/or for the offer on the Internet actually being accessible. The University of Vienna does not assume liability for any defects in prizes donated by cooperation partners.

All information is provided without guarantee; the promoter is not responsible for the correctness of the details provided by the participants (especially e-mail address and address). Participants are personally responsible for the correctness, completeness and usefulness of the data they provide – incorrect information is entirely at their own expense. If the relevant prize cannot be delivered due to reasons for which the operator is not responsible, the operator is not obliged to make another delivery attempt.

The promoter is not liable for technical failures that result in the unavailability of the prize draw, unless caused by intentional or grossly negligent behaviour. This also applies if the promoter’s website is unavailable.

The operator and any other companies involved do not assume liability for data loss, especially during data transmission, and other technical defects.

 Choice of law and other information

The prize draw is governed by Austrian law without the reference rules of international private law. If any provision of the terms and conditions is or becomes null or void, the remaining provisions of the terms and conditions will remain in full force and effect. It is replaced by an appropriate provision, which most closely corresponds to the purpose of the ineffective provision.

The prize draw is in no way connected to the social networks, such as META platforms (Facebook, Instagram or WhatsApp), Twitter, LinkedIn and Xing and is in no way sponsored, supported or organised by the above-mentioned social networks. The recipient of the data transferred by participants through non-public channels and of information provided through non-public channels is the University of Vienna, and not META platforms, Twitter, LinkedIn and Xing.
